Problem
A client filed an OWCP FECA claim for a torn meniscus.
Prior to our representation, OWCP ignored medical evidence by an orthopedic specialist, delayed adjudication, and denied the claim outright.
Solution
We filed a series of appeals and escalation letters on our client’s behalf.
We also worked with her physician to ensure the medical evidence on record was compliant with the FECA. OWCP accepted the claim and is now paying our client her entitled benefits. She will also now be eligible for a schedule award in the future when she reaches “Maximum Medical Improvement.”
Claim Expansion and Compensation Approval
Problem
A client filed an OWCP FECA claim for occupational injuries.
Prior to our representation, OWCP refused to “expand” our client’s claim to include all diagnosed conditions and refused to pay her wage loss compensation for an entire year.
Solution
We filed a series of appeals and escalation letters on our client’s behalf.
We worked with OWCP office directors to remedy previous improper actions. OWCP reinstated our client’s continuing compensation and she acquired a year’s worth of back-pay. We were also successful in expanding her claim to include consequential conditions so that proper medical care can now be acquired.
Fed Disability Retirement: Weighing Benefit Options
Problem
A client had an accepted OWCP FECA claim for an injury determined to be permanent by her physician.
The client was eligible for Federal Disability Retirement and was also having troubles with her employing agency.
Solution
We ensured that compliant evidence was on record.
With compliant medical evidence, we could justify her continuing eligibility to OWCP FECA wage loss compensation benefits. We then verified the client’s eligibility for Federal Disability Retirement and prepared her application, which was promptly approved. We discussed the monetary value of each benefit so our client could make the most economically favorable decision for her future, with the added protection of multiple options for disability benefits.
